Car rental terms of use and rental conditions

1- These Rental Terms and Conditions regulate the general principles regarding the car rental services provided by Everyday (ALG Filo Kiralama A.Ş.). By creating a reservation, receiving the vehicle, or signing the car rental agreement, the Lessee declares that they have read, understood, and accepted these Rental Terms and Conditions. These Rental Terms and Conditions are an integral part of the Car Rental Agreement signed between the parties.

  • No guarantee is provided for brand, color, or model in car rentals.
  • In accordance with the 70+ age rental conditions, Everyday reserves the right not to deliver the vehicle.
  • In the event of sea sand, pet hair, glitter, heavy dirt, or odor upon vehicle return, a DETAILED CLEANING FEE may be charged.
  • Vehicles are delivered clean to our guests, and they are expected to return them clean. Our guests who do not wish to lose time with vehicle cleaning can benefit from our Washing Package. The Washing Package is 200 TL per rental. If the package is not purchased and the vehicle is returned dirty, a washing fee varying by region, but not less than 450 TL, will be charged.
  • To ensure the satisfaction and protect the health of our guests, SMOKING is not permitted in our vehicles.

Entry Requirement for Customers with Foreign Driver's Licenses: Customers who will rent a vehicle with a foreign driver's license must have entered Turkey within the last 6 (six) months, covering the rental date. The customer is required to present the relevant entry record via the entry stamp on their passport, entry-exit records obtained through the e-Devlet system, or equivalent documents provided by official authorities. If the specified conditions are not met or the relevant documents cannot be presented, the company reserves the right to reject the car rental request.

2- The Lessee must comply with the highway regulations and the laws in force. In the event of any penal action due to vehicle use contrary to laws and regulations, the Lessee is responsible for the expenses (fines, vehicle impoundment, vehicle towing, etc.).

3- The Lessee is responsible for the penal actions and their accessories (traffic fines, expenses arising from the impoundment and towing of the rented vehicle, and other miscellaneous expenses arising from the relevant accident) applied as a result of accidents caused by acting contrary to highway traffic rules. The Lessee has been informed that they are the only person who can use the vehicle provided for their use under this Agreement they have signed, and that the right of use is not granted to any third party outside the agreement. In the event of a breach of this article, the vehicle delivery-return dates, or any article of the Agreement, the Lessee shall be liable for all damages incurred; the Lessor may claim and/or collect any damages it has suffered from the Lessee. If there is an Additional Driver, this provision shall also apply by analogy to the Additional Driver, and the Lessee and the Additional Driver shall be jointly and severally liable to the Lessor.

4- The minimum rental period is 1 day (24 hours). For shorter rentals, the daily rate applies. In case of delay, if the delay exceeds 2 hours, a full day's fee is charged.

5- The Lessee shall return and deliver the vehicle on the agreed day. For all extensions, the Lessee shall apply to Everyday offices / headquarters and obtain approval. In extensions made without approval, it is accepted by the parties that the Lessee holds the vehicle unlawfully in their possession.

6- At the beginning of the rental, vehicle users must present their driver's licenses and a usable credit card in their own name. Payments are made at the beginning of the rental with a valid credit card in their own name.

7- The LESSOR is authorized, not limited to the agreement period, and even if the agreement has expired, to collect parking, OGS, HGS, highway bridge, etc. toll fees, traffic fines, interest, and accessories, as well as service fees (179 TL for up to 900 TL, 20% for 900 TL and above) by deducting them from the LESSEE's credit card and/or deposit without requiring any permission, judgment, or notification.

8- Upon the Lessee's request, the following additional insurances that expand the insurance coverage can be purchased:

  • Mini Damage Insurance: Covers material damages (excluding tire, glass, and headlight damages) up to a specified amount that varies according to the vehicle group, with the customer's written declaration and without the need for a police report. For damages exceeding the amount specified by the mini damage insurance, the customer is responsible for the entire damage cost.
  • LCF Protection: Damages to a single tire damaged on its own without any damage to the bodywork or exterior parts of the rented vehicle (rim damages are not covered under this protection), or all glass and side mirror glasses (roof glass is not covered under this insurance), or damages to 1 headlight (including rear tail lights, signal lights) are covered under the LCF insurance.
  • Discretionary Financial Liability Insurance: Can be upgraded with additional coverages in addition to the compulsory financial liability insurance.
  • Personal Accident Insurance: Secures the driver and passengers inside the vehicle within the insurance limits.

9- In the event of damage and/or malfunction in the rented vehicle, the Lessee is responsible for delivering the vehicle to the authorized service in a safe manner that does not increase the damage. If support is not obtained from Everyday offices or the Everyday Roadside Assistance call center during the process of delivering the vehicle to the service, the towing cost will be paid by the Lessee. Since a damage file is created for post-damage processes, a Damage Service Fee will be requested from the Lessee regardless of whether there is a protection package or not.

10- The Renter shall return and deliver the vehicle in the condition it was received to the Everyday office in the city where the vehicle was rented or at another location specified on the front page, on the day and at the hour initially specified, or at an earlier date upon the request of the lessor.

11- The Renter is responsible, upon the lessor's request, for paying the following: the daily rental fee and/or mileage fee to be calculated based on the amounts specified on the front page for the days the vehicle was used and/or the distance traveled during the rental period; agreed insurance fees and other fees; the one-way fee if the vehicle is dropped off at a different office; value-added tax and other taxes for which they are liable; parking, traffic, or law violation fines and court costs issued to the vehicle during the rental period, except those arising from the lessor's fault; damage repair costs resulting from collision or rollover and compensations to be paid to third parties. The Renter may benefit from vehicle insurance provided that they sign the relevant "Accepts" box in the rental agreement and pay the deductible waiver premium. In order for a person other than the renter to drive the vehicle, valid identification and driver's license information must be written into the agreement at the beginning of the rental and the daily additional driver fee must be paid; otherwise, the purchased insurances shall be deemed invalid.

12- Although the Renter has accepted the Standard Insurance coverage and Mini Damage Insurance applied by Everyday, they agree to cover the damage liability and related expenses without objection if the vehicle is damaged under the following conditions:

  • Being under the influence of alcohol and/or drugs at the time of the accident,
  • The accident report/form stating that the accident was caused by the sole fault of the Renter,
  • It being stated that the legal speed limit was exceeded and the accident occurred due to speed,
  • Cases where no report is prepared in unilateral accidents, the declaration is incompletely filled out in bilateral accidents, or no alcohol report is obtained; intentional accidents; use of incorrect/illegal fuel; damages due to driving on the rim as a result of a flat tire; accidents caused by persons other than the drivers specified in the agreement; damages occurring on the upper parts of the vehicle (bridges, balconies, branches, etc.) — in these cases, the renter is obliged to pay even if traffic insurance and damage coverages have been purchased.
  • Material damages and medical expenses caused to 3rd parties and passengers inside the vehicle are limited to the compulsory traffic insurance limits of the vehicle, and all liability, including moral damages, belongs exclusively to the renter.
  • Tire puncture/damage, wheel rim damages not related to an accident (unless LCF coverage is purchased); loss of hubcap and spare tire; damage to registration documents, license plates, fire extinguisher, and in-vehicle equipment; loss/damage of keys; any kind of damage not covered by insurance.

13- The Renter shall pay the fee determined during the vehicle delivery, and any subsequent costs at the end of the rental by credit card. Renters working on a current account basis shall make their payments in cash or via bank transfer after the invoice is issued. If the Renter fails to pay their debt on time, they agree to pay 5% default interest from the invoice date without the need for any notice. In case of non-payment of the rental fee, Everyday is authorized to obtain a precautionary attachment and injunction without showing collateral.

14- The vehicle shall not be used: for passenger/cargo transportation for revenue, for towing/pushing any vehicle, for transporting goods contrary to customs and other laws, under the influence of alcohol (including below the legal limit) and/or drugs, in motor sports (racing, speed, rally, speed trials, etc.); on roads closed to traffic or unsuitable roads, in a manner exceeding the loading limit, with more people than its capacity, on roads not suitable for its technical structure (swamps, off-road, riverbeds, etc.), and by anyone other than the renter (without prior additional driver registration). Damages, expenses, and compensations arising from use contrary to these rules shall be paid by the renter.

15- In the event of damage to the vehicle provided to the Renter, a damage tracking fee of 5% of the damage amount is also charged to the renter. The Renter is obliged to take precautions against potential accidents/theft when not using the vehicle; to park it in a safe place with the doors locked and without leaving the registration documents in the vehicle. In case of theft of the vehicle, they must deliver the key and registration documents to the nearest Everyday office within 24 hours, provided that they prove they have notified the police.

16- In case of transporting goods or passengers with the vehicle, the renter is exclusively responsible for any damage and loss that may occur to the transported goods or passengers.

17- In the event of an accident resulting in material, fatal, or physical damage, the renter must immediately report the situation to the nearest police officers and deliver the reports and records to the relevant Everyday office within 24 hours at the latest.

18- The Renter or the authorized driver is insured under the traffic insurance policy. The lessor assumes the legal liability arising from accidents causing damage to 3rd parties within the coverage limits of the financial liability insurance; all compensation and liability exceeding this amount belong to the renter, and the lessor has the right of recourse. In the event of an accident, the Renter is obliged to obtain the names and addresses of the parties involved and witnesses, not to accept liability unless their responsibility is established, not to leave the vehicle without taking security precautions, to call the nearest Everyday office, and to have the necessary accident report completed.

19- The Renter shall be insured within the scope of the terms and conditions of the personal accident insurance policy concluded by the lessor with the insurance company, provided that they sign the front page and pay the prescribed fee.

20- In the event that the vehicle has a damage to be claimed from the insurance company, the renter is obliged to complete and submit the documents and procedures. During the period until the documents are completed, the agreement continues to run at the daily rental price.

21- The Lessor is not responsible for any objects and belongings left in the vehicle after taking back the vehicle. The Lessee is obliged to have the periodic maintenance of the vehicle carried out during the rental period in accordance with the instruction manual; invoices for procedures performed at authorized services with the knowledge of Everyday shall be deducted from the Lessee's debt. It is accepted that failure to deliver the vehicle upon the expiration of the contract period constitutes an offense under criminal law provisions, and that no insurance, coverage, or legal rights can be utilized for use outside the rental period.

22- When the rental period expires, the Lessee cannot unilaterally extend the period. Extension is only possible with the written consent of the Lessor. If consent is not granted, the Lessee shall deliver the vehicle on the day the rental period expires to the Lessor's address at "Ayazağa Mah. Azerbaycan Cad. Vadistanbul 1/B Blok No:36 Sarıyer / İstanbul" or to another address to be notified in writing. Rental extensions are subject to the terms of this agreement, even if a new agreement has not been signed.

23- In the event that the Lessee fails to comply with any article of the agreement, especially if they do not deliver the vehicle on the agreed date, the Lessee authorizes Everyday to immediately take back the vehicle wherever it may be without the need for prior warning; the Lessee is obliged to pay for any damages and expenses that may occur during the repossession.

24- The Lessor may unilaterally terminate this Agreement at any time by giving notice to the Lessee, including via email, fax, or SMS.

25- The rental conditions in the information brochures, which are not specified in this agreement but are printed by the Lessor and given to the customer at the beginning of the rental and accepted as an integral part of the agreement, are accepted as they are by the Lessee.

26- There are mileage limits for the use of the vehicles, and in case of exceeding the mileage, charges will be made in the amounts specified in the relevant table.

27- The Lessee irrevocably accepts, declares, and undertakes that they are aware that there are systems providing geographical location identification, primarily the vehicle tracking system, in the rented vehicle(s).

28- The parties accept and declare that in disputes that may arise from this agreement, the Lessor's documents, books, declarations, records, and computer records shall constitute the sole valid, binding, conclusive, and exclusive evidence.

29- All disputes arising from this agreement shall be finally resolved by arbitration in accordance with the Rules of the Istanbul Chamber of Commerce Arbitration and Mediation Center (ITOTAM). The language of arbitration shall be Turkish, the place of arbitration shall be Istanbul/Turkey, and Turkish law shall apply to the merits of the dispute.

30- Acting as an independent data controller, the Lessor may process and transfer the personal data of the Lessee collected in connection with this rental agreement for the purposes of managing the rental and commercial relationship, storing risk-posing events, verifying driving and credit information, reporting to relevant insurance/public institutions, collecting receivables, conducting customer satisfaction surveys, and sending marketing communications (subject to consent where necessary). For questions regarding the use of the Lessee's personal data, the Lessor should be contacted first.
